Lawmaker not giving up on 'puppy mill' law

DES MOINES --- An attempt to crack down on so-called "puppy mills" that would have allowed state officials to inspect federally licensed dog breeders failed to gain approval in the Legislature this year.

But a Davenport lawmaker is vowing to bring the issue before lawmakers again next year to help address the problem of dogs living in inhumane conditions.

"I definitely think there's a problem," said Rep. Jim Lykam, D-Davenport, one of the key sponsors of the legislation.

Supporters of the proposal said federal agriculture inspectors did a poor job of ensuring that federally licensed dog breeders were providing appropriate care.

Animal rights activists used horrific photos and disturbing anecdotes of dogs being mistreated in Iowa to make their case.

They included stories of malnourished dogs, dogs with severely matted hair because they weren't groomed and dogs that were crippled or acted frantic after being continuously caged.

The proposal in front of the Legislature would have let state agriculture inspectors check out Iowa facilities that hold federal licenses when they received a complaint of animal abuse or neglect.

The measure failed to gain traction with lawmakers as part of a budget bill in the closing hours of the 2009 session, which ended Sunday morning.

Instead, lawmakers approved an interim study on the issue, which Lykam hopes will shed light on what's happening in Iowa.

"We lost the battle, but we haven't lost the war," Lykam said. "This is still a live round."

Joe Gerst, a dog breeder from Amana and chairman of the Iowa Federation of Animal Owners, said the proposal didn't address what he says is the real problem --- unlicensed breeders.

He also is worried that people who had never seen a kennel still could make a complaint about it if they didn't like what breeders did for a living. Gerst said some animal rights activists are trying to put breeders like him out of business.

"Their definition of puppy mill is any place that raises a puppy for profit. It has nothing to do with the conditions in which they are raised," Gerst said.

He notes that the dogs at his facility had air conditioning several years before his house had it.

"We not only are licensed and inspected, but we care for our animals," Gerst said.

He acknowledges some in his industry need to improve, and he said he does not defend them.

The Humane Society of the United States (HSUS) has launched a 34-state offensive against people who raise dogs, and the heat has been turned up to high in Indiana, Illinois and Oklahoma, and now in Iowa. In all four states, actions are scheduled that may have a profound impact on everyone who loves their purebred dogs.

It is imperative for dog owners in all four states to take a stand now and play an active role in working to defeat this legislation.

HSUS claims the legislation is meant to regulate “puppy mills,” which is the derogatory term used by animal rights groups to describe commercial kennels.

In fact, however, all of this legislation actually is aimed at high quality avocational breeders of purebred dogs who are not involved in any way with the wholesale pet trade. The targeted breeders are the people who work the hardest and care the most about improving their chosen breed of dogs.

Action is scheduled on:

An Indiana bill that will make anyone who sells even one litter of puppies a year into a pet dealer. This bill was snuck through committee with no notice given to dog owners, and has gone to the full House for a vote. Many serious hobby breeders also would be classed as commercial kennels for very intense regulation and a prohibition of outdoor housing that is dangerous for hunting and working dogs. Many rescue groups also would be destroyed.

An Illinois bill snags up everyone who owns three intact breeding females under commercial kennel rules, and sets a 20-dog maximum on the number of sexually intact dogs that can be owned or possessed. Many trainers, handlers and serious hobby breeders would be harmed needlessly. We also urge dog owners to sign our online petition to stop this bill (see below).

And an Oklahoma bill passed through committee by an 11-2 vote and is headed toward the full House for a vote. This legislation targets anyone who sells, offers to sell, gives away or adopts out 25 or more dogs or puppies a year, by subjecting them to truly totalitarian enforcement measures. Some rescue programs would be destroyed.

Iowa is allegedly next on the Animal Rights Activist legislation list to destroy all Iowa dog kennel owners, hobby dog breeders, and Iowa hometown families having a single litter of puppies to give away at cost to friends, and families. The HSUS, PETA, and Animal Rights Activist Legislators and their supporters in Iowa are 'determined' to actively destroy thru Iowa legislation proposals, all your freedom in pet ownership rights, by falsely labeling anyone who sells a puppy or dog (for even a single $1) as an Iowa "puppy mill." Please write your Iowa Representative in your area to stop this 'propaganda' Animal Rights Activist campaign, falsely 'painting' all Iowans who own dogs, as criminals because they love their dogs and may have a litter of puppies in their families.

The American Sporting Dog Alliance recently released reports that have covered HSUS initiatives this year in Maine, Pennsylvania, New York, Maryland, New Jersey, Florida, Connecticut, New Hampshire, Rhode Island, Massachusetts, Tennessee, Illinois, Texas, Minnesota, California, Montana, Virginia, Colorado and Oregon. Updates and new reports will be released this week about legislation in California, Montana, Nebraska, Tennessee, Florida, Washington and Texas. HSUS-sanctioned legislation is expected soon in Ohio, North Carolina, Michigan, Arizona, New Mexico and Wisconsin.

HSUS is an extremist animal rights group with the long-range goal of eliminating all animal ownership in America. It recognizes the political impossibility of doing this immediately, and thus has adopted an incremental strategy of tightening the noose. Its strategy also is to develop and exploit sensational emotional issues, such as “puppy mills,” and then to extend the definition and impact far beyond the stated goals. HSUS, which has annual revenues in excess of $150 million and dozens of employees and professional lobbyists in many states, is the political arm for the animal rights movement. It does not operate a single animal shelter anywhere, despite its name.

HSUS has vowed to strike dog owners in 34 states early in 2009. Organizations that defend the rights of dog owners are, quite frankly, being overwhelmed by this concerted attack. HSUS learned a lesson last year, when dog owners were able to defeat them in almost every fight, because they were spread out over many months and allowed us to focus our limited resources. This year’s HSUS strategy is to attack everywhere at once, and use its army of highly paid employees and lobbyists to push through legislation quickly. It has the money, personnel and organization to wage this blitz attack, but dog owners simply lack the resources to effectively combat it. We have been placed totally on the defensive.

Thus, we are urging dog owners to get off of the sidelines and take a very active role. We also are urging you to support at least one organization that advocates for dog ownership rights with both donations and a sincere commitment of your time and talents.

We also urge dog owners to form alliances of mutual support with farm organizations, sportsmen’s groups, firearms rights advocates, landowners groups, and people who defend property rights. These diverse organizations fully understand the ramifications of the animal rights movement on American traditions and life.

The animal rights antichrists are in a frenzy. They are promoting the second coming of Oprah. To serve the puppy mill masters on a platter, and hopefully, disassemble every living dog breeder with a backyard in America at the same time. This is the agenda of animal rights activists, and allegedly of Oprah as well.


Both sides of the issue are in a manic stage awaiting the fall of the hammer and sickle, not to be confused with communism, but alike in that they both are dishing out 'tyranny' in potentially, and most probably stereotyping good home and hobby breeders of their own extended family of dogs. What a nightmare in the making awaiting to happen.


I have remained somewhat on the sidelines and have now decided to put in my two cents worth on Oprah puppy Mill mania as follows:


Animal Magnetism:


Animals, dogs, cats, birds, fowls, fishes, plants, and all forms of life along with the human species occupy an assigned sphere on this earth, and also play an eternal role in the great plan of creation, our redemption, and our ultimate hope for salvation of the eternal kind.


All animals, and especially the dogs were created with spirit entities, called a soul and live on this earth in a mortal way, and also go on in their time, not to a 'rainbow bridge' in reality but to an eternal salvation across the veil of earth's majestic sphere, assigned by God himself.


The animal rights activists, attempt to deal in a tyrannical way to hold down dogs, cats, and our pets and animals, either as equals to humans and having the same rights, while at the very same time, making legislation and provocative statements declaring animals ought to be free of man, and any control there of, to include their reproduction in any way, shape or form. The animal activists declaring this to be puppy mills, in the most general sense of their terminology.


The Oprah 'mill-mania' regarding the many aspects of proper and improper breeding of puppies should 'outrage' those of us who follow the Constitution and regard dogs as more than just mere chattel.


Oprah's presentation of a potential animal rights 'antichrist due process' by all rights, should include more than just going through the motions of a television hearing. In fact, even after the Oprah hearings have been aired with the alleged HSUS dirty laundry, decisions can then be challenged as a prejudicial abuse of dog discretion that is not based on findings of fact or animal law, let alone the accuracy of the populace of breeders in America at large, some of which own backyards.


Unfortunately the Oprah - HSUS ascandal to be aired will not provide any protective effects, merely punishment after the fact, by placing dog gone good family breeders in 'harms' way.'

'Animals C.L.U.B.- Freedom' National Organization is actively opposing restrictive legislation limiting the responsible breeding and ownership of all dogs, cats, and other pets, but apparently some 'perverted' anti-pet ownership mill-mania propaganda agendas may still make their way into the history books of Oprah TV. "We will see, or maybe we just won't."
